Hey Vivy Terms of Service

These Terms of Service ("Terms") govern your use of Hey Vivy, a health and longevity tracking application operated by Prateek Duggal ("Hey Vivy," "we," "our," or "us"). By using Hey Vivy, you agree to these Terms.

1. Eligibility and Account

You must be at least 18 years old to use Hey Vivy. You are responsible for maintaining the security of your account credentials and for all activity that occurs through your account.

2. Informational Use Only — No Medical Advice

Hey Vivy is provided for informational, educational, and personal tracking purposes only. It does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical care. Always consult a qualified healthcare professional for medical concerns.

3. Your Health Decisions

You are solely responsible for your health, treatment, supplement, protocol, and lifestyle decisions. Any actions you take based on data, charts, reminders, or AI-generated content are at your own risk.

4. AI Features and Accuracy Disclaimer

Hey Vivy may offer AI-powered summaries or recommendations. AI output can be incomplete, inaccurate, or outdated. We do not guarantee the accuracy, reliability, or fitness of AI-generated content for any purpose.

5. User Content and Community Posts

You retain ownership of content you create and upload, including check-ins, notes, and community posts ("User Content"). By posting User Content in community features, you grant Hey Vivy a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the service.

You are responsible for ensuring your User Content does not violate any law or third-party rights.

6. Acceptable Use

You agree not to:

• Use Hey Vivy for unlawful, fraudulent, or harmful purposes.
• Attempt to disrupt, probe, or compromise system security.
• Upload malicious code or abusive content.
• Scrape, resell, or reverse engineer the service unlawfully.

7. Subscriptions and Billing

Hey Vivy may offer paid subscriptions, including a future Pro tier with additional features. If paid plans are introduced, pricing, billing periods, renewal terms, and cancellation details will be disclosed before purchase. Unless stated otherwise, subscriptions automatically renew until canceled.

8. Account Suspension or Termination

We may suspend or terminate access to Hey Vivy if we reasonably believe you violated these Terms, created security risk, abused other users, or used the service in a way that may cause legal or operational harm. You may stop using the service at any time and may request account deletion.

9. Disclaimer of Warranties

Hey Vivy is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Hey Vivy and Prateek Duggal are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from or related to your use of the service. Where liability cannot be excluded, total liability is limited to the amount you paid (if any) to use Hey Vivy in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Hey Vivy and Prateek Duggal from claims, liabilities, damages, and expenses arising from your use of the service, your User Content, or your violation of these Terms.

12. Dispute Resolution and Governing Law

Any dispute arising out of or relating to these Terms or Hey Vivy will be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive any right to participate in class actions or class arbitration.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The seat of arbitration and venue for permitted court proceedings will be in Texas.

13. Changes to These Terms

We may update these Terms periodically. Continued use of Hey Vivy after updated Terms become effective means you accept the revised Terms.
